Öz

Bu çalışma, yeni bir toplum ve siyaset inşa etmek üzere yola çıkan modern cumhuriyetlerin kuruluşunu ele almaktadır. İncelemenin odağında, cumhuriyetçi felsefedeki yasa kavramı vardır. Siyasal iktidarın yasa karşısındaki konumu, cumhuriyetlerin demokratik mi ya da otoriter bir yol mu izleyeceğine dair bir fikir vermektedir. Hukuki bir inceleme niteliği taşımayan bu çalışma, siyaset felsefesiyle yakın siyasi tarih disiplini sınırları içinde kalarak Amerikan ve Fransız Cumhuriyetleri deneyimlerinden hareket etmektedir. Makalenin amacı, Türkiye’de Cumhuriyet’in kuruluşunda siyasal iktidarın (temel) yasa karşısındaki konumunu incelemektir. Bu bağlamda, kuruluşta erkler ayrılığına dayalı bir hükümet düzeninin kurulamamasının idare ve yargı kurumu üzerindeki sonuçları tartışılmaktadır. Geniş bir arka plana sahip olan konu, Türkiye’de Cumhuriyet’in kuruluşun ilk evresi sayılabilecek Birinci Meclis dönemiyle (1920-1923) sınırlı tutulmaktadır.

The Republic, the Law and the Establishment of Modern Politics in Türkiye

Abstract

This study is about establishing modern republics that set out to build a new society and politics. At the center of the analysis is the concept of law in republican philosophy. The position of political power vis-à-vis the law provides an insight into whether republics will follow a democratic or an authoritarian path. The study does not qualify as a legal analysis and moves from the experiences of American and French Republics by staying within the boundaries of political philosophy and discipline of recent political history. The article aims to analyze the position of political power vis-a-vis the law at the foundation of the Republic in Türkiye. In this context, the consequences of failing to establish a governmental order based on the separation of powers at the foundation of the Republic on the administrative and judicial institutions are discussed. Since the issue has a broad background, it is limited to the period of the First Assembly (1920-1923) which can be considered as the first phase of the Republican Establishment.
