Sivil itaatsizlik, H.David Thoreau’nun kavramsallaştırdığı, demokratik bir toplumda siyasal toplumun ortaya koyduğu hukuk normu ve uygulamanın, adalet, insan hakları gibi sivil ve siyasal toplumun temelini oluşturan ilkelere aykırı olduğu yönünde sivil toplumu oluşturan bireylerin, sivil toplum üzerinden siyasal topluma mesaj verme amaçlı, şiddete başvurmayan, kamuya açık bir eylemidir. Sivil itaatsizlik temel bir insan hakkıdır. Çoğulculuk ve farklılığın esas olduğu modern sivil toplumlarda çoğunluğun yönetme hakkını esas alan temsili demokrasi ile toplumun tamamını kucaklaması gereken hukukun uyuşturulabilmesi; hukukun, adalet, insan hakları gibi temel değerlere sahip olmasına bağlıdır. konumundaki bireylerin, hukuk ve uygulanmasına yönelik barışçıl itiraz ve değerlendirmeleri pozitif hukuk normuna aykırı olsa da sivil itaatsizlik olarak meşrudur.

Civil Disobedience and Law
Abstract
Civil disobedience is a form of action conceptualized by H. David Thoreau. In a democratic society, the legal norm and practice set forth by the political society must comply with principles such as justice and human rights. These principles form the basis of civil and political society. Civil disobedience is a message of the individuals who make up the civil society towards the political society through civil society that the legal norm and practice are against the basic principles. Civil disobedience is a fundamental human right. Pluralism and difference are essential in modern civil societies. Representative democracy is based on the right of the majority to rule. Law, on the other hand, must embrace the entire society. In order for the law and representative democracy to be compatible, the law should enclose basic values such as justice and human rights. The peaceful objections and evaluations of the minority individuals in the civil society against their law and practice are legitimate as civil disobedience, even if they are against the positive norms.
